Welcome to DMARC GUY, a service of Solutions LastSpam Inc. ("we," "us," or "our"), Saint-Eustache, Québec J7R 6J9, Canada — a provider of email compliance and deliverability solutions. By accessing or using our website, services, or tools (collectively, the "Services"), you agree to be bound by these Terms of Service ("ToS"). 1. Acceptance of Terms

By using our Services, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these ToS.

DMARC GUY provides tools and services designed to improve email compliance, security, and deliverability, including but not limited to DMARC policy analysis and email authentication solutions. We strive to enhance your email performance and compliance with industry standards, such as DMARC, SPF, and DKIM.

3. No Guarantee of Results

While DMARC GUY will make every reasonable effort to improve your email compliance and deliverability, we do not guarantee specific outcomes. Email deliverability and compliance depend on various factors beyond our control, including third-party email providers, user configurations, and external policies. You acknowledge that:

  • We are not responsible for any negative impact, loss, or damages that may occur during or after your use of our Services.
  • Any changes to your email infrastructure or policies based on our recommendations are implemented at your own risk.

4. User Responsibilities

You agree to:

  • Provide accurate and complete information when using our Services.
  • Use our Services in compliance with all applicable laws and regulations.
  • Refrain from using our Services for any unlawful, harmful, or unauthorized purpose.
  • Not attempt to reverse-engineer, hack, or interfere with our Services.

5. Limitation of Liability

To the fullest extent permitted by applicable law, DMARC GUY, its affiliates, officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Services, including loss of data, business interruption, loss of profits, or financial losses resulting from email deliverability issues or compliance failures.

Where liability cannot lawfully be excluded, our total aggregate liability for all claims relating to the Services is limited to the greater of (a) the amounts you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) CAD $100.

Nothing in these ToS excludes or limits liability that cannot be excluded or limited under the law of Québec, including liability for gross or intentional fault, or for bodily or moral injury.

6. Indemnification

You agree to indemnify and hold DMARC GUY harmless from any claims, losses, or damages, including legal fees, arising from your use of the Services or violation of these ToS.

7. Termination

We reserve the right to suspend or terminate your access to the Services at our discretion, with or without notice, for any reason, including violation of these ToS. You may discontinue using the Services at any time.

8. Changes to the ToS

We may update these ToS from time to time. We will notify you of significant changes by posting the updated ToS on our website or via email. Your continued use of the Services after such changes constitutes acceptance of the revised ToS.

9. Governing Law

These ToS are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising under these ToS will be brought before the courts of the judicial district of Terrebonne, Province of Québec, which will have exclusive jurisdiction, subject to any mandatory right a consumer has under Québec law to bring proceedings in the district of their own domicile.
